House Bill 257

Davis Technical College complies with Utah House Bill 257, codified in Utah Code Title 63G, Chapter 31, effective January 30th, 2024. The following information outlines the college’s responsibilities and addresses relevant questions. This applies to students, faculty, staff, and visitors.

Is it illegal to use a restroom that does not match your sex assigned at birth?

No. It is legal to use the restroom matching your gender identity, even if it does not match your sex assigned at birth, unless the restroom is attached to or located within a changing room.

However, certain behavior is (and always has been) criminal regardless of your gender identity or which restroom you are in, including lewdness, harassment, voyeurism, and loitering.

Does the law restrict how people can use restrooms?

This law does not restrict or ban the use of restrooms on campus unless the restroom is within or attached to a changing room.

Changing rooms, including those attached to or within a restroom designated for a single sex that differs from the individual’s sex assigned at birth, are restricted unless that person has both (1) amended the sex designation on their birth certificate, and (2) undergone primary sex characteristic surgery.
